Appellant, N.O.L., filed this action against the District of Columbia, seeking damages for the Districts failure to inform him that his wife, F.L., had tested positive for the human immunodeficiency virus (HIV), which causes the disease known as AIDS. He alleged that the failure of physicians at Saint Elizabeths Hospital, where his wife was a patient in early 1988, to tell him that she was HIV-positive constituted negligent infliction of emotional distress when her condition was finally made known to him some time later. After a series of rulings on various pre-trial motions, the case went to trial before a jury in January 1994. At the close of the plaintiffs case, the court granted the Districts motion for judgment as a matter of law on three alternative grounds. N.O.L. appeals; we affirm.
